'Win a Nana' Term & Conditions
Promotion:
Your entry into and participation in any Facebook or Instagram Competition communicated via any post on this Edmonds Facebook or Instagram page that links to these T&Cs (Competition Post) is deemed acceptance of these Terms and Conditions which includes any information on how to enter and prizes.
Who can enter?
Entry is open to residents of New Zealand aged 18 years or over. You are not eligible to enter if you are an employee of the Promoter or its related corporations or agencies, or a member of an employee’s immediate family.
Promotional Period:
The Promotion will commence on the date and time set out in the Competition Post and will close at the time indicated in the Competition Post (Promotional Period).
How to enter:
To enter any Promotion and be eligible to win, you must, during the Promotional Period, follow the instructions set out in the Competition Post, including by submitting your video to the Edmonds Facebook or Instagram page as set out below. Entries submitted via any other method may not be accepted. You are not permitted to use any automated entry software or any other mechanical or electronic means that allows you to automatically enter or enter repeatedly and you are responsible for any associated costs such as internet access.
Video must be sent Edmonds Instagram or Facebook page:
Your video must be sent to the Edmonds Instagram or Facebook page in order for the Promoter to receive and judge your entry and communicate with you. Neither the Promoter nor any other entity associated with this Promotion will be responsible for any late, lost, misdirected, corrupted, incomplete or incorrectly submitted entries.
Game of skill:
This Promotion is a game of skill. Chance plays no part in determining the winner. All eligible entries will be individually judged based on the judging criteria stated in the Competition Post (which may include, for example, creativity, originality, suitability for the Edmonds brand and how well the entry answers any prompts). The entry judged to be the best will win the prize. The Promoter’s decision is final and no correspondence will be entered into.
Prize:
This Prize will be as indicated in the Competition Post. The Prize is not transferable, changeable or redeemable for cash, unless otherwise set out in the Competition Post. The Promoter reserves the right to provide an alternative prize of equal monetary value in the event that a prize or any part of a prize becomes unavailable for any reason beyond the Promoter's control.
Notification to winner(s):
Winners will be directly contacted by the official Edmonds account on the social media platform that the Competition Post was published (Facebook or Instagram) using the direct message (or other messaging functionality available on that platform).
Accepting the Prize:
Following the announcement, winners will need to respond to the private message from the official Edmonds social media account with the winner’s contact details. This will enable the Promoter to supply the prize and will be deemed to be acceptance of the prize. If the winner does not accept the prize within seven (7) days of being notified, the prize will be forfeited. The Promoter reserves the right to award any forfeited prize to another eligible entrant.
Filming permissions and releases:
The prize includes a filmed “Nana” experience as described in the Competition Post. By accepting the prize, the winner agrees to (and must ensure all participating flatmates agree to) take part in filming and photography of the experience for Edmonds’ advertising, promotional and related content. The winner (and participating flatmates) acknowledges that Edmonds may edit the footage and may publish it on Edmonds’ social channels and digital platforms following filming. Edmonds will use reasonable endeavours to consult with the winner on filming logistics and to notify the winner before the content is first published.
The winner must ensure that each participating flatmate (and any other person appearing in the filming) is aged 18 years or over and is willing to be filmed, photographed and recorded, and to have their image/voice used. The winner and participating flatmates may be required to sign a standard appearance release (and/or location release) provided by the Promoter before filming occurs. If, in the Promoter’s reasonable opinion, the winner (or participating flatmates) are unwilling or unable to participate in filming, or do not sign any required releases, the prize may be forfeited and awarded to another eligible entrant.
Health & safety:
The winner and participating flatmates must comply with all reasonable directions of the Promoter and its representatives in connection with the prize experience (including filming), including any health and safety requirements. The Promoter may stop, suspend or cancel the prize experience if it reasonably considers it unsafe or inappropriate to continue.
Your entry:
You promise and warrant that all the details submitted with your entry are true and correct, and, if you post or upload a photo, video or written response; that you have all of the necessary rights, consents and licences to grant the rights to the Promoter as set out in these Terms and Conditions; your entry is original, solely your own and has not been communicated to the public before; your entry (including any visible and/or audible third‑party music, footage, or logos) does not infringe the intellectual property rights of any third party; and the exercise of any rights granted by you to the Promoter is at the complete discretion of the Promoter, including any communication of your entry to the public. You also promise and warrant that: any person who appears in your entry has consented to be filmed/recorded and for the entry to be submitted and used by the Promoter in accordance with these Terms and Conditions.
License:
By submitting your entry, you grant the Promoter and its licensees and assignees a perpetual, world-wide, royalty free, licence to use, reproduce, publish, communicate and otherwise exploit your entry content for the purposes of administering the Promotion and for advertising and promotional purposes (including reposting or republishing). You consent to your entry being edited or adapted by the Promoter. For the avoidance of doubt, the filming and content created as part of the prize experience is addressed separately above under the heading “Filming permissions and releases”.
Facebook terms:
Entry into any promotion on the Edmonds Facebook page is dependent on you following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at: www.facebook.com/terms.php. Please note that you do not have to tag your friends or share any content on your page or a friend’s page as part of any entry.
Instagram terms:
Entry into any promotion on the Edmonds Instagram page is dependent on you following and acting in accordance with the Instagram Terms of Use, which can be viewed at: https://help.instagram.com/478745558852511.
No endorsement:
You acknowledge and agree that the Promotion is in no way sponsored, endorsed or administered by, or associated with any software, application or website used to enter the Promotion, including Facebook and Instagram. If you use any software, application or website to enter the Promotion, that use is subject to any applicable terms of use. In the event of any inconsistency between such terms and these Terms and Conditions, these Terms and Conditions will prevail.
Promoter’s rights:
The Promoter reserves the right to: disallow entries in its absolute discretion; verify the validity of entries and determine the eligibility of entrants (including an entrant's identity) and to disqualify any entry or refuse to award a prize where dishonest or misleading details have been given by an entrant, or where an entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these Terms and Conditions or the spirit of the Promotion; to terminate this Promotion or amend any aspect of this Promotion (including the prize) without notice at any time in its sole discretion in the event that this Promotion or any aspect of this Promotion cannot be reasonably conducted as planned; and enforce any of its rights at any stage and failure to do so does not constitute a waiver of those rights.
Exclusion:
The Promoter shall not be liable for any loss or damage whatsoever which is or may be suffered (including but not limited to indirect or consequential loss) or for personal injury which is or may be suffered or sustained, in connection with participation in the promotion or accepting any prize, except for any liability which cannot be excluded by law.
Indemnity:
As a condition of participating in a promotion, the winner indemnifies the Promoter, all organisers, sponsors and all other persons and organisations associated in any way with that promotion against all claims, damages, liabilities, costs and expenses (including legal fees on a solicitor and client basis) which the Promoter may incur arising out of the winner’s participation in the Promotion and/or participation in a prize, howsoever caused.
Publicity:
By entering the Promotion or accepting a prize you consent to the use of your name, likeness, image or voice in any media for an unlimited period of time without remuneration for the purposes of the Promotion (including announcing the winner) and promoting any products manufactured, supplied or distributed by the Promoter.
Privacy:
The information collected about entrants in the course of the Promotion has been requested to enable the Promoter to conduct the Promotion in accordance with these Terms and Conditions (including publicity), and for promotional purposes. All personal information collected will be in accordance with the Goodman Fielder Privacy Policy which can be found here: http://goodmanfielder.com/privacy-policy/.

A request to access, update or correct any information should be directed to the Promoter at their address set out below.
Inconsistencies:
The Competition Post may include additional details specific to the Promotion (such as entry period, judging criteria and prize details). Those details form part of these Terms and Conditions. If there is any inconsistency between the and these Terms and Conditions, the Promoter will determine how the inconsistency will be resolved, acting reasonably.
Promoter:
The promoter is Goodman Fielder New Zealand Limited of 2/8 Nelson Street, Auckland CBD, Auckland 1010. All decisions of the Promoter are final and no correspondence will be entered into.
